THIS DOCUMENT is an agreement between you, the Licensee, and Netted Automation GmbH. BY OPENING THIS SEALED PACKAGE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT (hereinafter the "Agreement").

If you do not agree to the terms of this Agreement, return the CD-ROM and accompanying materials with your invoice to the location from which you purchased this CD-ROM, and your money will be refunded.

This License allows you to use the four components of the CD-ROM (client, server, and analyzer software, and the documentation) each on a single computer only. You are expressly prohibited from copying, duplication reproducing, or transferring the materials on this CD-ROM for any purpose other than installing the server, client, and analyzer software for typical information, research, demonstration, and evaluation purposes only.

You may copy limited portions of the documentation materials on the CD-ROM provided that EPRI's, KEMA's, LiveData's, NettedAutomation's, Tamarack's, or SISCO's copyright and proprietary data notices are included.

This CD-ROM contains copyrighted materials and you may not modify, rent, lease, sell, use for any other purpose except as specifically provided herein, or create derivative works based upon the CD-ROM. You may not reverse engineer, decompile, or disassemble the software on the CD-ROM. You may not use documentation or software on this CD-ROM on a network without a network license.

You may not use or copy the product except as expressly provided for in this license. You may not transfer possession of the product to another party without first obtaining the express prior written permission of Netted Automation.

This license is effective until terminated. You may terminate it at any time by returning the CD-ROM to the location from which you purchased this CD-ROM. Failure to comply with any of the terms of this agreement will automatically terminate this agreement.

This project was prepared by EPRI, KEMA, LiveData, NettedAutomation, Tamarack, and SISCO (the "DEVELOPERS"). THE CD-ROM AND ACCOMPANYING WRITTEN MATERIALS (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE DEVELOPERS, OR ANY AFFILIATES OR MEMBERS OF THE DEVELOPER'S ORGANIZATIONS, DO NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF THE USE, OF THE CD-ROM OR WRITTEN MATERIALS IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENCY, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCT IS ASSUMED BY LICENSEE. IF THE PRODUCT OR WRITTEN MATERIALS ARE DEFECTIVE, LICENSEE ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.
NEITHER THE DEVELOPERS, ANY AFFILIATES OR MEMBERS OF THE DEVELOPER'S ORGANIZATIONS, NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THIS PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE SUCH PRODUCT EVEN IF THE DEVELOPERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

It is expressly understood and agreed that all right, title, and interest in and to the contents of the CD-ROM, any copies made thereof, and any updates that may be provided, vests solely and exclusively with Netted Automation and its licensors. You, the Licensee, shall neither derive nor assert any title or interest in or to such materials except for the rights of use and licenses granted under this Agreement. Any rights and licenses not granted hereunder are specifically reserved by Netted Automation or its licensors.

In case any one or more of the provisions contained in this agreement or any application of those provisions shall be invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions contained in this agreement and any other applications of such remaining provisions shall not in any way be affected or impaired by such invalidity, illegality or unenforceability.

8. Integration
You have read and understand this agreement, and acknowledge that it is the final, complete and exclusive agreement between you and EPRI, KEMA, LiveData, NettedAutomation, Tamarack, and SISCO concerning its subject matter, superseding any prior related understanding or agreement. No waiver, variation or different terms of this agreement will be enforceable against EPRI, KEMA, LiveData, NettedAutomation, Tamarack, and SISCO unless EPRI, KEMA, LiveData, NettedAutomation, Tamarack, or SISCO gives its prior written consent, signed by an officer of one of this organizations.
